Team63 Solutions Inc. ("Team63") has developed an application software which facilitates the booking by third-parties of certain sport facilities, among other functionalities (the "CatchCorner App"). This Privacy Policy explains how Team63 collects, uses, discloses, and retains your personal information, including information collected through the CatchCorner App. Team63 does not collect any personal information except as set out below or you specifically provide it to Team63. Your use of the CatchCorner App is also governed by Team63’s Terms and Conditions of Use. The Terms outline your rights, obligations, and responsibilities while this Privacy Policy explains how we collect, use, and protect your personal information. By using the CatchCorner App, you agree to both the Terms and Conditions and this Privacy Policy.

1. Your Consent. By accessing or using the CatchCorner App or providing personal information to Team63, you consent to the collection, use, disclosure, and retention of that information in accordance with this Privacy Policy and as otherwise permitted by applicable law. You may withdraw your consent at any time, subject to legal or contractual restrictions and on reasonable notice to Team63. To withdraw consent, contact info@catchcorner.com with the subject line 'Withdraw Consent.' We will process your request within 3 business days.. If you withdraw your consent, you might not be able to receive the full benefit of the CatchCorner App.

If you are under the age of 18 (or the age of majority in your jurisdiction), you may only use the CatchCorner App with the involvement and consent of your parent or legal guardian. By using the CatchCorner App, you represent and warrant that your parent or legal guardian has reviewed and agreed to this Privacy Policy on your behalf and has provided consent to the collection, use, disclosure, retention, and deletion of your personal information as described herein.

If you breach any provision of this Privacy Policy, or are no longer using the CatchCorner App for the purposes permitted in this Privacy Policy, you may no longer use the CatchCorner App. Team63 may, at any time and for any reason and in its sole discretion, change, suspend or terminate, temporarily or permanently, the CatchCorner App or any part of it, or your permission to use the CatchCorner App, without any prior notice or liability to you or any other person. If this Privacy Policy or your permission to use the CatchCorner App is terminated by you or Team63 for any reason, then this Privacy Policy will continue to apply and be binding upon you in respect of your prior use of the CatchCorner App.

2. Types of Personal Information We Collect. In this Privacy Policy, “personal information” means information about an identifiable individual, such as an individual’s name, email address and phone number. To the extent permitted by law, personal information does not include information that is publicly available in a public directory or that is business contact information that enables an individual to be contacted at a place of business.

3. How Team63 Collects Personal Information
(a) Direct Collection
You may voluntarily provide your personal information to Team63, including when you subscribe to Team63’s mailing list. In those circumstances, you can choose not to provide certain requested personal information, but then you may not be able to access or use certain features offered by Team63. If you give Team63 the personal information of another individual, then you are solely responsible for complying with all applicable laws, including obtaining the individual’s valid consent, regarding your collection and disclosure of the personal information to Team63 and to Team63’s use, disclosure and retention of the personal information.

(b) Websites, Cookies and Other Technologies
The CatchCorner App may automatically collect certain information regarding your use of the CatchCorner App, such as the dates and times you access or use the CatchCorner App; the browsers, operating systems and devices you use to access the CatchCorner App; and the referring and exit website pages.

The CatchCorner App may also use “cookies” and other similar technologies, such as web beacons, pixel or gif tags, and action tags. Those technologies collect information that assist Team63 to improve the CatchCorner App and its services and products and to communicate to you. Team63 may use information collected through cookies and similar technologies to recognize you as a user of the CatchCorner App, track your use of the CatchCorner App, and otherwise facilitate and improve your experience on the CatchCorner App. Team63 may use web beacons, pixel or gif tags, and action tags to confirm that email messages have been delivered to and opened by you.

Some information collected by cookies and similar technologies are non-personal information, except that if internet protocol (IP) addresses or other similar identifiers are considered personal information under your local laws then Team63 will treat that information as personal information for the purposes of this Privacy Policy. You may choose to decline or disable cookies if your web browser permits, but doing so may affect your ability to access or use certain features of the CatchCorner App.

4. How Team63 Uses Personal Information. Team63 may use your personal information collected by Team63 for purposes relating to or arising from your relationship and transactions with Team63 and as otherwise set out in this Privacy Policy or permitted by applicable law, including: (i) to administer your relationship with Team63, including to contact and correspond with you regarding those matters; (ii) to facilitate your interactions and transactions with Team63; (iii) to facilitate your interactions and transactions with a given facility at which you have made a booking; (iv) to provide products and services to you; (v) to process and respond to your inquiries, requests and other communications; (vi) to provide you with information (including by email and other electronic messages) regarding Team63 and its business, products and services and products and services offered by other businesses, to the extent permitted by applicable law; (vii) to administer and facilitate your participation in contests and promotions related to Team63; (viii) to maintain, protect and improve Team63’s products and services and to develop new products and services; and (ix) to protect and enforce Team63’s legal rights, interests and remedies and to protect the business, operations and customers of Team63 or other persons.

Team63 will not share or sell your personal information to third parties for marketing or advertising purposes. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. This excludes text messaging originator opt-in data and consent.

5. How Team63 Discloses Personal Information
(a) General
Team63 discloses your personal information for purposes relating to or arising from your relationship and transactions with Team63 and as otherwise set out in this Privacy Policy or permitted by applicable law. Team63 may disclose your personal information in accordance with express or implied consents that you provide during your interactions with Team63.

(b) Affiliates
Team63 and its affiliates may share your personal information with each other and may use, disclose, transfer and retain your personal information in accordance with this Privacy Policy. Upon booking, your Booking Name, Email Address, and Phone Number is shared with the facility at which you have made a booking. This information is stored by the facility in an archive. If you wish for the facility to dispose of this information, you must contact the facility directly. Team63 is not responsible or liable for the acts, omissions, or data practices of any facility.

(c) Legal Disclosures
Team63 may disclose personal information about you as required or authorized by applicable law, in order to:  (1) protect the legal rights, interests, remedies privacy, safety, property, business, or operations of Team63 or its employees, agents, contractors or the public; (2) protect the safety and security of visitors to the CatchCorner App; (3) protect against fraud or other illegal activity or for risk management purposes; (4) respond to inquiries or requests from legal authorities; (5) respond to an emergency; (6) comply with the law or legal process; (8) or as otherwise required under all applicable legislation.

Team63 has no control over, or responsibility or liability for, the use, disclosure, retention and deletion of your personal information by the agencies, organizations or other persons to whom Team63 discloses the information in the foregoing circumstances, and the use, disclosure, retention and deletion of the disclosed information by those agencies, organizations or other persons is not subject to this Privacy Policy.

(d) Business Transactions
Team63 may disclose your personal information in connection with a proposed or actual business transaction in which Team63is involved (e.g. a corporate amalgamation, reorganization, merger or acquisition, or the sale or transfer of some or all of Team63’s business or assets), but Team63will require the information recipient to agree to protect the privacy of your personal information in a manner that is consistent with this Privacy Policy and applicable law.

(e) Service Providers
As applicable, Team63 may disclose your personal information to Team63’s service providers to assist Team63 in the provision of services to you, to provide products and services to Team63, to assist Team63 to use your personal information in accordance with this Privacy Policy and as otherwise permitted by applicable law. Team63 requires its service providers to agree to use your personal information only for the purposes for which it is provided to them (for instance, payment information is only shared with our service providers to facilitate debit and credit card processing) and to protect the privacy of your personal information in a manner that is consistent with this Privacy Policy.

In the event Team63 transfers or intends to transfer personal information to a service provider outside of Canada, Team63 will provide notification at the time of collection of personal information or when the information is transferred.

6. Retention, Location and Protection of Personal Information. Team63 retains your personal information for the period reasonably necessary for the purposes set forth or referenced in this Privacy Policy and to comply with Team63’s legal obligations or enforce or protect its legal rights, or a longer retention period required or permitted by applicable law. Specifically, booking data is retained for a minimum of 5 years. Account data is retained until account deletion plus 1 year.

Team63 and its service providers may process, store and use your personal information at facilities in various countries, including Canada, the United States of America and one or more countries in Europe or Asia. The personal information protection laws of those other countries might be different from the laws of the jurisdiction in which you reside, and might permit courts, government, law enforcement agencies, regulatory agencies and security authorities to access your personal information without notice. By providing your personal information to Team63, you consent to the transfer of the personal information to facilities located in other countries and the processing and storage of the personal information at those facilities.

Team63 employs reasonable safeguards, including administrative, physical and technical security and safeguarding measures, appropriate to the sensitivity of the personal information in Team63’s possession or under Team63’s control in order to protect the information from unauthorized access, collection, use, disclosure, disposal or similar risks. For instance, Team63 has obtained an SSL secure certificate and uses SSL secure systems. Further, the debit and credit card payment processing through the CatchCorner App is performed via Stripe integration, a global PCI Service Provider Level 1, which is the highest grade of payment processing security. Nevertheless, security risks cannot be eliminated and Team63 cannot guarantee that your personal information will not be accessed, used, disclosed or deleted in ways not otherwise described in this Privacy Policy.

7. Deletion of Personal Information. Team63 retains personal information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, to comply with legal and regulatory obligations, to resolve disputes, and to enforce its agreements. When personal information is no longer required for these purposes, Team63 will, at its discretion and subject to applicable law: (a) securely delete the information; (b) anonymize or de-identify the information so that it can no longer be associated with an identifiable individual; or (c) retain the information in a secure archived form where deletion is not feasible or permitted. Notwithstanding the foregoing, certain personal information (including booking and transactional records) may be retained for minimum statutory or business record-keeping periods. Personal information shared with third-party facilities is retained and controlled by those facilities in accordance with their own policies. Team63 does not control and is not responsible for the deletion, retention, or use of such information by third parties. Requests to delete such information must be directed to the applicable facility. While Team63 will take reasonable steps to process deletion requests, you acknowledge that complete deletion of all data (including from backups, archives, or systems maintained by third parties) may not always be possible.

8. Accuracy and Access to Personal Information. Team63 will rely on you to ensure that the personal information you provide to Team63 is as accurate, complete and up to date as necessary for the purposes for which Team63 uses the personal information. You will promptly notify Team63 of any changes to your personal information by using the contact information noted below. You are responsible for maintaining the confidentiality of your account credentials.

You may request access to your personal information collected by Team 63 and information about Team63’s collection, use, disclosure, retention and deletion of your personal information by submitting a written request to Team63 using the contact information noted below. Subject to applicable exceptions and limitations prescribed by applicable law, you will be given reasonable access to your personal information within a reasonable time and you will be entitled to challenge the accuracy and completeness of your personal information and to have it amended as appropriate. Team63 may decline to process a request that is unreasonably repetitive, frivolous, vexatious or impracticable, that infringes or jeopardizes the privacy of other persons, or for other reasons permitted by applicable law.

9. Non-Personal Information. Team63 may use personal information to create non-personal information (information that is not about an identifiable individual), and Team63 may then use, disclose, transfer and retain the non-personal information for any purpose and in any manner whatsoever. Non-personal information includes personal information that has been aggregated or depersonalized so that the information no longer relates to an identifiable individual. If non-personal information is combined with personal information, then the non-personal information will be treated as personal information for the purposes of this Privacy Policy.

10. Limitation of Liability. To the maximum extent permitted by applicable law, Team63 and its affiliates, officers, directors, employees, agents, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, including without limitation damages for loss of profits, loss of data, loss of business opportunities, business interruption, or loss of goodwill, arising out of or relating to your use of, or inability to use, the CatchCorner App, even if Team63 has been advised of the possibility of such damages. Without limiting the foregoing, Team63 shall not be liable for: (a) the acts, omissions, or conduct of any third-party facilities, users, or service providers; (b) unauthorized access to or alteration of your personal information; (c) any errors, inaccuracies, or omissions in content or bookings; (d) any interruption or cessation of service; or (e) damages to the extent caused by negligence, to the maximum extent permitted by applicable law. In no event shall Team63’s total cumulative liability to you for all claims arising out of or relating to this Privacy Policy or your use of the CatchCorner App exceed the greater of (i) the total amount paid by you to Team63 in the twelve (12) months preceding the claim, or (ii) one hundred Canadian dollars (CAD $100).

11. Disclaimer of Warranties. The CatchCorner App and all related services are provided on an “as is” and “as available” basis, without any representations, warranties, or conditions of any kind, whether express, implied, statutory, or collateral. To the maximum extent permitted by applicable law, Team63 expressly disclaims all warranties and conditions, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and availability. Team63 does not warrant that: (a) the CatchCorner App will be uninterrupted, secure, or error-free; (b) any defects will be corrected; (c) bookings or facility availability will be accurate or reliable; or (d) the App will meet your expectations or requirements. You acknowledge that you do not rely on any representations not expressly set out in this Policy.

12. Indemnification. You agree to indemnify, defend, and hold harmless Team63, its affiliates, officers, directors, employees, agents, and service providers from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including legal fees on a full indemnity basis) arising out of or relating to: (a) your use or misuse of the CatchCorner App; (b) your breach of this Privacy Policy or any applicable law or regulation; (c) your violation of any rights of any third party, including privacy or intellectual property rights; or (d) any personal information or content that you submit, post, or transmit through the CatchCorner App.

13. Force Majeure. Team63 shall not be liable for any failure or delay in the performance of its obligations under this Privacy Policy or in the operation of the CatchCorner App if such failure or delay results from events beyond its reasonable control. Such events may include, without limitation, acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, labor disputes, governmental actions, power failures, internet or telecommunications outages, cyberattacks, system failures, or failures of third-party service providers. During any such event, Team63’s obligations shall be suspended or excused for the duration of the event, and Team63 shall be entitled to a reasonable period of time to resume normal operations.

14. Governing Law. This Agreement shall be governed solely by the laws of the Province of Ontario, Canada and applicable federal laws of Canada. Any dispute between Team63 and you or any other person arising from, connected with or relating to the Website, this Agreement or any related matters must be resolved before the Courts of the Province of Ontario sitting in the City of Toronto.

15. Other Matters.
(a) Users under 18 years of age: Team63 permits individuals under the age of 18 (or the age of majority in their jurisdiction) to use the CatchCorner App only with the consent and supervision of a parent or legal guardian. If you are under 18, you may only use the CatchCorner App if your parent or legal guardian has reviewed and agreed to this Privacy Policy on your behalf and has consented to the collection, use, disclosure, retention, and deletion of your personal information as described herein. If Team63 learns that it has inadvertently collected the personal information of a user under 18 years of age without appropriate consent, Team63 will use reasonable efforts to delete that information from its systems (except to the extent that retention of the personal information is required or permitted by applicable law).

(b) Other Websites/Online Services:  The CatchCorner App may contain links to other websites or online services. When you use those links you are contacting another website or service. Team63 has no responsibility or liability for, or control over, those other websites or service or their collection, use, disclosure, retention and deletion of your personal information. Please refer to the privacy policies and terms of use that apply to those other websites or online services.

(c) Social Networking: When you use the CatchCorner App or post information to other social networking sites (e.g. links to Team63’s Facebook, Twitter, Instagram, YouTube, LinkedIn, Pinterest, or Google pages), the personal information that you post or share in connection with these third party sites is visible to other persons and can be read, collected, used and disclosed by other persons, including to send unsolicited messages. In such a case, you will be leaving the CatchCorner App and going to the third party’s website. Any information provided to such third party social networking sites and other sites is governed by their own privacy policies. You are solely responsible for the personal information that you choose to post or share in those situations. Team63 has no control over, or responsibility or liability for, the use, disclosure and retention of the personal information that you disclose in those situations, and the use, disclosure and retention of the disclosed information is not subject to this Privacy Policy.

(e) English Language: You and Team63 have each expressly requested and required that this Privacy Policy and all other related documents be drawn up in the English language. (f) Changes to this Policy:  Team63 may revise this Privacy Policy from time to time. You are advised to review this Privacy Policy to see if it has been updated since the last time you used the CatchCorner App. Changes to this Privacy Policy are effective when they are posted, which date will appear at the top of this Privacy Policy. If Team63 makes any material changes to this Privacy Policy, Team63 will notify you either through the email address you have provided us or by placing a prominent notice on the CatchCorner App. By using the CatchCorner App after any revised Privacy Policy has been posted, you are agreeing to be bound by the then current version of the Privacy Policy. You may not change this Privacy Policy in any manner. Material changes are defined as changes that significantly affect your rights, obligations, or the collection, use, or disclosure of personal information.

16. Entire Agreement. This Privacy Policy constitutes the entire agreement between you and Team63 with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. In the event of any conflict between this Privacy Policy and any other agreement between you and Team63, including the Terms of Service, the terms that provide greater protection to Team63 shall govern to the maximum extent permitted by applicable law.
